Land use in NSW is regulated by the Environmental Planning and Assessment Act 1979 (EP&A Act). The Act allows plans to be made to guide the process of development and to regulate competing land uses. These plans include Local Environmental Plans (LEPs) and State Environment Planning Policies (SEPPs).

The Act is currently under review. The review was announced in July 2011 and is expected to take approximately 18 months comprising three distinct phases:

Listening and Scoping

Issues Paper

  • Submissions and comments received in the Listening and Scoping phase have been used to produce an Issues Paper.
  • The Issues Paper was released for public comment 6 December 2011. Submissions in response to the Issues Paper are due 17 February 2012. NSW Farmers will be lodging a submission, and given the significance of the planning system to every farmer across NSW, encourages members to do likewise.

Policy Options Release

A green paper will be released in April 2012, setting out the recommended preferred structure for a new planning system, with legislation to follow some months later.


Local Environmental Plans

Members should be aware that all Local Governments in NSW are in the process of developing their Local Environmental Plans (‘LEPs’). Members need to be alert to the potential for environmental zonings created under the new LEPs to restrict their current and future landuse. The new LEPs may also affect controls on subdivision.  NSW Farmers encourages all members to immediately contact their Local Council to establish the process by which they will be consulted about the development of the LEP for their area and, specifically, about any zoning changes that directly affect their land.
